Terms of Service

These Terms of Service (hereinafter “Terms”) govern the use of FamPi! (hereinafter “the App”). By using the App, you are deemed to have agreed to these Terms.

1. Service Overview

  • The App provides a family-only, closed messaging service.
  • In addition to messages and stamps, it provides features such as voice calls and location sharing intended for monitoring children’s safety.
  • There is no search feature, public profile, or connection to users outside the family.

2. Accounts

2.1 Roles

  • Master: One per family. Has the authority to create the family, send invitations, and manage members.
  • Adult / Child: Members invited by the master.

2.2 Account Creation

  • The master authenticates via Apple, Google, or email address.
  • Adult / child members can join only through an invite code issued by the master.

2.3 Use by Minors

  • Children under 13 must use the App under the supervision of their guardian (master).
  • Guardians are responsible for managing the child’s account and data.

3. Prohibited Conduct

Users must not engage in the following actions when using the App:

  • Violating laws or public order
  • Impersonating others or registering false information
  • Intentionally leaking invite codes to people outside the family
  • Interfering with the operation of the App
  • Reverse engineering, exploiting vulnerabilities, or automated mass access
  • Defaming, harassing, or sending sexual or violent content to other users
  • Misusing the location sharing feature beyond its safety-monitoring purpose, such as to surveil or stalk other members
  • Commercial solicitation, religious proselytization, or spam through the App

4. Handling of Data

  • Data collected and handled by the App is governed by the separate “Privacy Policy”.
  • Messages are shared within the family and are visible to all family members.
  • Deleted messages and accounts cannot be restored as a rule.

5. Disclaimer (Important)

5.1 Data Loss and Accidental Deletion

  • All data stored in the App — including messages, call history, family information, member avatar images, stamp history, notification data, and any other data — may be lost, corrupted, or accidentally deleted for any reason, including server outages, outages of cloud services such as Firestore or Cloud Storage, bugs, user error, third-party service outages, device failure, or cache loss.
  • We assume no liability whatsoever for any loss, corruption, or accidental deletion of data, regardless of cause.
  • Users are responsible, at their own risk, for keeping separate backups of important information (e.g., saving to the device or to a photo library).

5.2 No Warranty (As-Is)

  • The App is provided on an “as-is” basis.
  • We make no warranties, express or implied, as to the completeness, accuracy, reliability, usefulness, fitness for a particular purpose, infallibility, or continued availability of the App.
  • We reserve the right to change, add, or remove the contents and features of the App at any time without prior notice to users.
  • We are not liable for any damage caused to users or third parties by the use of the App.

5.3 Family Communication

  • The App is designed for the exchange of messages, stamps, and calls between family members. We do not intervene in, and assume no liability for, any incidents, accidents, interpersonal trouble, or physical or psychological effects arising from the content of communications exchanged between users.
  • All decisions regarding inviting, joining, or removing family members, as well as the management of invite codes, are the sole responsibility of users.
  • Guardians are responsible for ensuring safe use of the App by children.

5.4 Third-Party Service Outages

  • We are not liable if the App becomes unavailable due to outages or specification changes of third-party services such as Apple, Google, or Firebase.

5.5 Limitation of Liability

  • Even where we are found to be liable under applicable law, our total aggregate liability to a user shall be capped at the total amount actually paid by that user to us for use of the App during the twelve (12) months preceding the event giving rise to the claim.
  • For users who use the App free of charge, the cap on damages shall be JPY 1,000.
  • This limitation applies to the maximum extent permitted by law, except where rendered invalid by the Consumer Contract Act of Japan or other mandatory legal provisions.

6. Paid Plans and Billing

6.1 Roles Eligible to Purchase

  • Subscription to, modification of, or cancellation of paid plans can be performed only from the family master account.
  • Adult and child accounts do not have access to billing features.
  • The benefits of a paid plan purchased by the master automatically apply to all members of that family.

6.2 Payment and Management

  • Payments are processed through the Apple App Store or Google Play. Receipts, renewals, and cancellations follow the terms of each platform.
  • The technical processing of subscriptions may go through a subscription management service (e.g., RevenueCat).
  • Plan details, pricing, and feature differences are published in the in-app Help and on our website.

6.3 Auto-Renewing Subscriptions

  • Paid plans are auto-renewing subscriptions. To cancel, please use the subscription management settings in the Apple App Store or Google Play.
  • Unless canceled, the subscription will be automatically charged at each renewal cycle.

6.4 Protection for Child Accounts

  • Child accounts do not have access to billing screens or upgrade prompts.
  • When a child taps a paid feature such as a special stamp or color theme, the App shows a dialog reading “Please ask a grown-up” and does not navigate to any billing screen.
  • This is intended to structurally prevent unintended purchases by children.

7. Service Changes, Suspension, and Termination

  • We may add, modify, suspend, or terminate features of the App without prior notice.
  • We are not liable for any damage to users or third parties caused by such changes.
  • Even in the event of scheduled maintenance, incident response, or other temporary suspension or termination of the service at our discretion, we have no obligation to refund any fees already paid by users, nor to provide any alternative service.
  • We will not honor requests for refunds of fees already paid, except where a refund is mandated by applicable law.

8. Account Deletion and Suspension

  • Users may delete their account at any time via the App.
  • We may delete or suspend accounts of users who violate these Terms without prior notice.

9. Intellectual Property

  • All intellectual property rights in the App (programs, designs, logos, etc.) belong to us.
  • Rights in user-submitted content (such as messages) remain with the users, but users agree to allow us to use such content as necessary to provide the App’s services.

10. Amendments

  • These Terms may be amended according to changes in law or the App’s features.
  • Significant changes will be announced within the App or on our website.
  • Continued use of the App after changes constitutes acceptance of the amended Terms.

11. Governing Law and Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of Japan.
  • Any disputes regarding the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over our location, as the court of first instance.
